These Terms of Service apply to your use of our website and to every purchase you make in our online store. Please read them before you order. Nothing in these terms limits the rights you have as a consumer under mandatory law.

1. Who we are

This website is operated by SARKY. (trading as SARKY Fashion), Vosmaerstraat 11, 2524 SK Den Haag, the Netherlands. You can reach us by email at info@sarkyfashion.com. In these terms, "we", "us" and "our" refer to SARKY.

2. Products

We do our best to show our products, colours, sizes, descriptions and images as accurately as possible. Colours can look slightly different depending on your screen. Products may be supplied by our fulfilment partners on our behalf. We may update or stop offering products at any time; this does not affect orders that have already been confirmed.

3. Prices

All prices are shown in euros and include VAT where applicable. Shipping costs are shown at checkout before you pay. Prices can change at any time, but the price shown when you place your order is the price that applies to that order. If a price or product information is obviously wrong, we will contact you before the order is accepted, and you can choose whether to keep or cancel it.

4. Your order and our contract

When you place an order, you make an offer to buy. You will receive an order confirmation by email. The contract is concluded when we accept your order, which we do by sending a shipping confirmation or by delivering the goods, or earlier if we say so in the confirmation. We may refuse or cancel an order for a valid reason, for example suspected fraud, incorrect information or stock problems. If we cancel an order after you paid, we refund you in full.

5. Payment

You pay at the time of purchase, using the payment methods offered at checkout. At the time of writing these include Klarna, credit and debit cards and PayPal, and, depending on your device, express payment options. Payments are handled by third-party payment providers. We do not store your full payment card details.

6. Delivery

We deliver without undue delay and, unless we agreed otherwise, no later than 30 days after you place your order. Delivery times, shipping costs and the countries we deliver to are explained in our Shipping Policy.

7. Right of withdrawal and returns

As a consumer, you can withdraw from your order within 14 days after you receive the goods, without giving a reason. How this works, what it costs and how refunds are handled is explained in our Return & Refund Policy, which includes the model withdrawal form. You can also use our online withdrawal form.

8. Faulty or non-conforming goods

Goods must match the description and be fit for normal use. If an item is faulty, damaged or not what you ordered, you have statutory rights under Dutch consumer law, including repair, replacement, a price reduction or a refund. Please contact us as soon as you notice a problem.

9. Complaints

If you are not satisfied, please tell us at info@sarkyfashion.com with your order number. We aim to reply within 2 business days and to resolve your complaint as quickly as possible. Your right to bring a dispute before a court or another competent body remains unaffected.

10. Using our website

You agree not to use our website for unlawful purposes, to provide false information, to interfere with the security of the website, or to copy or misuse our content without permission.

11. Intellectual property

The content of this website, including logos, images, text, graphics, product descriptions and design elements, belongs to SARKY. or is used with permission. You may not copy, reproduce or distribute it without our written permission.

12. Third-party services

Our website uses third-party services, such as our shop platform, payment providers and carriers. We are not responsible for the content or policies of third-party websites we do not operate. Our own responsibility towards you for your order is not affected by our use of these services.

13. Liability

We are liable to you in accordance with the law. We do not exclude or limit liability where the law does not allow it, including liability for intent or gross negligence, and your statutory consumer rights always remain in place.

14. Changes to these terms

We may update these terms for future orders and future use of the website. The version that applies to your order is the version in force when you placed it. Changes to these terms do not affect orders that were already concluded, except where the law allows or requires otherwise.

15. Applicable law

Dutch law applies to these terms and to our contracts with you. If you are a consumer living in another country, you also keep the protection of the mandatory consumer rules of your country of residence.
